Does Litigation Make Sense?
As we say elsewhere on our site, litigation may be an option after other attempts at resolving a dispute have failed. Before jumping into litigation, you should determine whether the potential benefit outweighs the expense, hassle, and emotional toll involved. Consider also whether it is even necessary to resolve the dispute... for example, it is usually best to try to negotiate with the other party first and sometimes mediate before filing suit. If litigation appears to be the best course of action after considering what you have done so far and what your remaining options are, we will help you explore the process further.
Type of Litigation
Our firm has experience in a variety of litigation types, but we do not handle everything. Rather, we engage only select litigation cases, including most personal injury and guardianship cases as well as some other areas. If your dispute is in an area of law we rarely or never practice in, such as employment law, know in advance that we are likely to refer you to a different attorney that is more specialized. However, if we feel we might be a good fit for what your needs are, we are happy to explore that opportunity further with you. If you are unsure, talk to us... you have nothing to lose!
Process Forward
If your legal dispute requires potential court action and we mutually agree we are the right firm to represent you, we prepare you for the process of litigation. The process may vary tremendously depending on what your dispute is. Some cases, such as complex personal injury, have more involved processes while others cases, such as small contract disputes, are simple. All cases entering litigation have potential to go to trial, despite attempts to resolve them along the way; accordingly, all cases are treated as though they are going to trial. Even if it seems unusual or even unsettling, keep in mind that litigation follows a set of rules. These rules create a process that the courts use for a reason, and we will help you navigate this process.
